Terms of Use

By accessing or using Polyx (the “Service”) you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) to register an account. By registering you confirm that you meet that age and that you are legally capable of entering this contract.

If you are using Polyx on behalf of a company, you confirm that you have the authority to bind that company. References to “you” in these Terms apply to both you personally and the entity you represent.

You are responsible for keeping your account credentials safe and for all activity that occurs under your account. Notify us at support@polyx.digital immediately if you suspect unauthorised access.

One person, one account. Sharing accounts violates these Terms. Team plans (when available) provide a structured way to share access.

We may suspend or terminate accounts that violate these Terms, with or without notice depending on the severity.

Credits are a virtual currency you purchase to use AI generations and to buy assets from the Marketplace. Credits are not money, are non-transferable between accounts, and have no cash value.

Payments are processed by Stripe. Polyx never sees or stores your full card details. Prices are listed in EUR; conversion to your local currency is handled by your card issuer.

Credits never expire. Credits remain in your balance until spent or until your account is closed.

Refunds. We refund the unused portion of credits on request within 14 days of purchase, processed to the original payment method. Credits already spent on AI generations or asset downloads are non-refundable, because the underlying GPU compute and creator royalties have been incurred.

Every asset on Polyx — generated or purchased — is delivered under one of three license tiers. The applicable license is shown on the asset detail page and on the receipt.

Standard license. Use the asset in unlimited commercial and non-commercial projects (games, film, products, advertising, marketing). You may not redistribute the raw 3D files outside of the final product (no resale of the source GLB / FBX / OBJ on a marketplace).

Extended license. All Standard rights, plus the right to redistribute the raw asset within derivative products (asset packs, courses, NFT collections, 3D-print STL bundles). Extended is required when you intend to resell the asset itself.

CC0. Public domain. Use freely, modify, redistribute, with or without attribution. No restrictions of any kind.

You retain ownership of, and commercial rights to, assets you generate using Polyx, subject to applicable law and any third-party rights in the inputs you provide (for example, an image you upload as a reference).

You are responsible for ensuring that your input prompts and reference images do not infringe third-party intellectual property, publicity, or privacy rights.

Polyx may, in aggregated and anonymised form, use technical signals about generation quality to improve the Service. We do not use your prompts or generated assets to train third-party models, and we do not share them with other users.

You agree not to use the Service to generate or distribute content that is:

• Illegal under the laws of your jurisdiction or the United Kingdom;
• Sexually explicit involving minors, or that sexualises minors in any form;
• Designed to harass, defame, or impersonate a real person without consent;
• Used to produce deepfakes that defraud, manipulate elections, or spread medical / financial misinformation;
• Designed to circumvent the safety filters of the Service.

Violations may result in immediate account termination and, where required, reporting to the relevant authorities.

We aim for high availability but do not currently guarantee a specific uptime SLA. Maintenance windows, third-party infrastructure outages, or rate-limit spikes may cause temporary unavailability. We will publish status updates when material outages occur.

If we discontinue a feature, we will give reasonable notice — typically at least 30 days — and provide a way for you to export your data.

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we exclude all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is capped at the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) EUR 100.

Nothing in these Terms limits liability for fraud, gross negligence, death, or personal injury.

These Terms are governed by the laws of England and Wales. Disputes will be heard in the courts of England and Wales, except where mandatory consumer protection rules in your country of residence give you the right to bring proceedings locally.

Before issuing legal proceedings we ask that you contact us at support@polyx.digital so we can attempt to resolve the matter informally.

We may update these Terms from time to time. The latest version is always published at polyx.digital/legal/terms with a new “Last updated” date.

Material changes will be communicated by email to your registered address at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the new Terms.
